BPH information about starting a collective dispute with the unions representing the employees of the Bank

Bank BPH SA (The “Bank”) announces that two of the five operating in the Bank of trade unions (ie. The “Solidarity” organization factory at Bank BPH SA and the Independent Trade Union of Workers of Banking and Services “Dialog 2005″) entered into with the Bank in a labor dispute. This is a consequence of the rejection by the Board requests put forward by the trade unions, which include:

1. provide employees restructured within the framework of collective redundancies the same conditions as in the framework of collective redundancies taking place in 2012.
2. the use of the same conditions as described in paragraph 1 above, to employees transferring to new employers on the basis of art. 23 (1) § 1 of the Labour Code in connection with the transfer of the Bank’s own branches to franchisees.

Requests union organizations resulting from the announced restructuring of the distribution network of the Bank and the ensuing restructuring of employment, which is linked to the adoption by Bank business transformation plan for the years 2015 – 2020, about which the Bank informed in the current Report No. 29/2015 of 29 December 2015.

the Management Board is of the opinion that the expectations of social sites were considered, although there is a discrepancy regarding the amount of compensation. This is reflected in:

1. signed “Agreement on detailed rules for termination of employment of Bank BPH SA of employment for reasons not attributable to employees in the period from 10 February 2016 until 31 December 2016.”, which was concluded between the Bank and the Inter-Organization Employees Banking and Services No. 06-005 staff nucleus of a nationwide union “Confederation of Labor”, which joined the Organisation for inter Employees of Bank Pekao SA and BPH SA, the Company’s Independent Union of Workers of Banking and Services. The agreement was concluded February 9, 2016 of the year and applies to employees of Bank BPH with the exception of employees of the Bank’s branches, which will be transferred to franchisees
2. adopted by the Management Board 19 February 2016 year, “Regulations on establishing conditions for the payment of benefits to the employees of the branches of the Bank BPH SA acquired by the new employer (franchisees) pursuant to Art. 23 (1) § 1 of the Labour Code in connection with the transition to these parts workplace Bank BPH SA “.

the Management Board announces that the February 19, 2016, in accordance with the Act on the settlement of collective disputes, the Bank will send to the District Labour Inspector in Gdansk notice of entry in a dispute with two of the five operating Bank’s trade union organizations.

the Management Board will take legal action to resolve the dispute and stresses that the utmost care that the proposed solutions were fair compensation for employees affected by the restructuring plan of employment, while taking into account the financial situation of the Bank.
