EU wants better protection for clients of insurance companies – On 24

Customers purchasing insurance will have to be better informed about the products they choose, and the nature in which there is insurance salesman and his salary. New wider obligations on distributors of insurance requires EU directive IDD, which should be implemented in the Member States within two years. It is intended to safeguard the interests of customers, but as experts emphasize, that the client receives more information does not mean that it will be better informed.

– The new directive requires all distributors of insurance more extensive disclosure obligations – indicates in an interview with news agency Newseria Business Luke Zon, president of the Association of Polish Insurance and Reinsurance Brokers. – It applies to all retailers, and not only brokers but also insurance companies and their employees, as well as people involved in the sale of insurance as an extra activity.

– The increasing information obligations imposed on the distributors of insurance due to the fact that in most countries of the European Union insurance intermediaries can exist in two roles – can be either agents or insurance brokers. Polish legal system adopts a strict division between them, that is, the client knows whether the person is a representative of the insurance company or just an intermediary, which should take care of first and foremost the interests of the client – says Lukasz Zoń.

Under the question remains is in what form the Polish law will be implemented in EU legislation. The scenario is not excluded that the legislature adopts the West European model.

– In addition, the distributor of insurance will be required prior to concluding an insurance contract to recognize the needs of the customer. Based on the information that the client forward, the distributor shall examine the insurance needs and will select the right product. Another element introduced by the Directive is the obligation on distributors obligation of continuous training, which so far concerned only the intermediaries. All sellers will be required to document the activities related to training and other such operations.

As the Zoń, Polish market for insurance mediation should have no problems in adapting to the new rules. The more so because today the information obligations are quite wide.

– It is important to the implementation and construction of the new obligations imposed on distributors not to lose sight of what is most important, that the information to be the customer actually useful. Because an excess of information, often transmitted exaggerated, it does not serve the good of the client, who is not able to this information to read, not to mention the meaning – emphasized the president of the Association of Polish Insurance and Reinsurance Brokers.

The Directive shall enter into force 23 February 2016 year, and the Member States have the time to implement it until 23 February 2018 year.
