Greenberg Traurig represented the company in the notification of a … – The Republic

law firm Greenberg Traurig represented PGE, KGHM, TAURON and ENEA in the notification of a concentration to the Office. The Authority has agreed to the agreement on the first nuclear power plant in Poland.

Greenberg Traurig has prepared a request to the Office of Competition and Consumer Protection in connection with the agreement signed between PGE SA and KGHM SA, TAURON SA and ENEA SA PGE to purchase 10% stake in the SPV – PGE EJ 1 – responsible for the preparation and construction of the first nuclear power plant in Poland.

Feedback to the OCCP has been prepared by the Legal Protection of Competition Law Team Greenberg Traurig: Anna Cienkus and Anthony Boleckiego . Because the transaction has an impact on a number of markets in which these companies operate, preparation of the application to the Office require intensive work and a lot of experience.

The Office of Competition and Consumer Protection concluded that the creation of a common purpose company PGE, KGHM, TAURON and ENEA will not lead to a restriction of competition, as well as shared the view of the notifying that the transaction will have a positive impact on the national economy.

According to the regulations, the transaction was notifiable to the OCCP, since it involves enterprises whose total turnover in 2013 exceeded one billion euros in the world, and 50 million in Poland.
