Improved tax collection will give the budget a minimum of 12 billion zł in 2017., 10 billion zł in 2018. Zł and 8 billion in the next – said PAP deputy head of the Ministry of Finance Wieslaw Jasinski. He added that his ministry also proposes legislative changes introducing higher penalties for issuing fictitious invoices.
Criminal groups have done to deal with the structure of VAT Eldorado; I am here for this, to do a cop and chase them – emphasizes Jasinski.
PAP: How much according to estimates of the Ministry is the gap in VAT and CIT? To date, the Ministry of Finance itself is not determined the size of these gaps.
Wieslaw Jasinski: I agree that it is not PwC and other consulting firms, only the Ministry of Finance should determine the gap, for this purpose we are going. Estimates of external determine the gap in VAT forty several billion, and subject me to the Department of Tax Control estimates that there may be much more.
As for CIT, even audit firms do not define the gap in the tax, interesting why … Clearly, however, we have a problem with CIT-I. Since 2011 Following the study by Global Financial Integrity. They show absolutely Poland in a bad light – we are the only EU Member State for several years represented in the top twenty countries with the largest scale tax avoidance CIT, alongside Serbia, Russia or Belarus. For 2014 Polish CIT gap estimated at twenty billion dollars.
PAP: Law and Justice went to the elections with the slogan improve tax collection, budget spending increased significantly – including in connection with the 500+. While next year will be announced so achieved by better collection of taxes?
W.J .: Deputy Minister Leszek Skiba talked about 12 billion zł, and I reiterate it. We are planning that next year our efforts will bring at least 12 billion zł, 2018 – 10 billion zł, and in the next 8 billion zł. As the sealing system, these additional benefits will be less and less.
PAP: How resort wants therefore lead to an improvement in tax collection?
WJ: When it comes to VAT, we have to do organized crime treasury. Criminal groups have done to deal with the tax structure Eldorado. There will always be some in the VAT gap. Therefore, continuously we have to identify these gaps and then just change the law to eliminate them.
These changes in the law must be permanent – even every quarter. We must be extremely offensive and dynamic. Here you can not waste time, because it comes to the fight against organized crime generates huge losses in the state budget. At the same time as we construct these rules, not an explicit responsibilities of honest taxpayers. So we have to very precisely identify the mechanism used by criminals.
PAP: But the legislative process is not so fast.
W.J .: Exactly! The more that we need to consult these changes with Brussels. Now we have prepared draft amendments to laws on excise duty, tax on goods and services, fiscal control, Tax Law and Energy Law. We are going to change the definition of the registered destination, so that more associate it with the VAT system.
PAP: The project will be government or parliamentary?
WJ: I do not know, the path of Deputies is faster, much we depend on the effective combating of crime in VAT, and this requires urgent action. Next, we plan to change in relation to other industries – the first fire will go fuel, then, Spirit, etc.
PAP: Is – if fraud VAT is the work of organized crime groups – should take care of them officials of the tax control, or rather but the police?
WJ: the best qualified in this case are employees of fiscal control. We establish the National Tax Administration (KAS), which will be a strong organization dedicated to the support of the taxpayer, but mainly fighting crime duty. To this end, we will strengthen KAS department fighting crime. The police do not do this, because it is not prepared to fight against tax offenses.
PAP: Is the issue of penalties for tax offenses need some change in the Penal Code? Now imprisonment are used sporadically – a matter the courts or laws?
WJ: Rules.
PAP: You need to change it?
WJ: Yes, with the change has already stepped out. December 22 turned the letter in this regard to the Ministry of Justice, which is the host of the Penal Code. We proposed an amendment added: “Who invoice, giving it an untruth as to perform the operations referred to in Article 106a of the VAT Act is punishable by deprivation of liberty for up to 5 years.” In general, we are in favor of greater punishment for issuing fictitious invoices. Then I will analyze whether the criminal repression is effective. Currently, criminal statistics are in fact strikingly low, but this is due to the faulty construction of the Penal Code.
Even greater problems we have with the Code of criminal tax. Some of its provisions are interpreted in different ways, which makes them ineffective. That is why we have proposed comprehensive changes further specifying the code that the courts had no doubt how to use it. We also propose increasing the penalties. It will also be soon sent to the Ministry of Justice.
PAP: The PiS election campaign heralded a completely new design of the VAT Act, which, among others, anticipated liquidation of the reverse VAT and the introduction of a central register of invoices. From the unofficial information that the Ministry of Finance no enthusiasm for this project. What can we expect in this regard?
W.J: First, we have a small amendment to the VAT Act. What a big change, the key is what happens in Brussels, and there are already considering only two projects EU VAT regulations. The first is a common VAT reversed, and the second involves the settlement of tax WNT already in the country of consignment but at the rates in force in the country of destination. I do not know which will go. Depending on decisions in Brussels, we will make decisions.
PAP: So there will be a central register of invoices?
WJ: So far from July 1 will be operational Single File Control for large companies and two years for other companies. It is an initiative of employees of fiscal control, who recognized that the control can be improved. This will be good for both the state and the taxpayers, because we do not predict the controls and harass honest taxpayers. This initiative definitely sealing system, however, the central register of invoices will be even more effective when it comes to sealing the VAT system. It would be the most effective solution when it comes to profitability.
Over the central register of invoices we work conceptually, but it requires legislative changes. Would require a vast information campaign explaining, what this solution is that taxpayers wished to accept it, would apply to it because all taxpayers.
PAP: When the log could move?
WJ: No I give a precise date.
PAP: And what ideas do you have for patching holes in the CIT?
WJ: a lot of promise after the clause to circumvent the law, which will come into force this year. Tax Control Office in Warsaw, which is engaged in the CIT-I waiting for this solution. This is the main unit in Poland, which has the best results in the fight against evasion CIT.
Another thing is to target a larger number of people to fight to cut back on CIT relating to transfer pricing. During several years of fiscal control generated only 130 specialists in this field, to 2.5 thousand. inspectors fiscal control! Such a state of things I found in December, no nothing in this area did not. Now it’s catching up, we train these people. We have selected for inspection on the year hundreds of actors now need people who will carry out these inspections.
Another problem associated with the mentality of employees of fiscal control. To illustrate the problem, I give you an example of UKS in a small region in which up to now to transfer pricing is not addressed. New, young director chose actors to control and asks me if he could take the subject with the participation of the state capital of Spanish. He feared international conflict. It shows the way of thinking of the people that we have to change quickly.
PAP: Are not you afraid the subsequent allegations of “shooting the whip on entrepreneurs’ tax authorities in Poland has a terrible image of what you intend to do to convince Poles that the tax depends on the quality of life for all of us?
WJ: I’m from that to do here as a police officer and prosecute organized crime. The Ministry of Finance are others responsible for education and I can support them.
PAP, abo
