The financial collateral tour operators and travel agents in the event of insolvency, will be strengthened by the creation of the so-called. the second pillar of financial security, namely the introduction of the Tourist Guarantee Fund, which is to constitute a separate account in the Insurance Guarantee Fund (complementary system).
Additional funds to cover the cost of return
The system will allow a complementary collection of resources in case the financial security of the organizers and travel agents will not be enough to cover the cost of return and refund customers. To cover the costs of return in the first place will be the means of basic security system, in the second – with a complementary system. This solution will increase the confidence of customers to tour operators and travel agents, and to increase the level of customer protection.
A separate bank account
The creation of the Tourist Guarantee Fund – in the form of a separate bank account – maintained by the Insurance Guarantee Fund means that there will be costs incurred related to the appointment of a new legal person.
The cost of operating the Tourist Guarantee Fund by UFG will be covered by contributions from travel agencies (deposit business). The contribution rate is expected to be from 0 to 30 zł and will depend on the type of event tourism and the associated risks. At the same time depending on the situation on the tourist market and the amount of funds collected in the TFG – premiums will be higher or lower. For example, in the case of tourist events in Poland and the neighboring countries, whose organization is fraught with negligible risk office will be subject to a zero rate. According to the draft amendment, the protection – resulting from the operation of the TFG – will be covered by customers of travel agencies entered in the register of tour operators and travel agents established in Poland – regardless of the amount of premium payable.

Premiums and declarations will be brought to the TFG – 21 day of the month immediately following the month for which contributions are paid and submitted declarations.
The obligation to declare and contributions will be built along with getting through a travel agent entry in the register of tour operators and travel agents.

It was proposed that in case of shortage of funds in the account of the Tourist Guarantee Fund it can be supplemented with money from loans and credits contracted by the Insurance Guarantee Fund for the TFG. These commitments are to be repaid solely from the contributions received from entrepreneurs. It was planned that travel agencies will have to maintain a list of contracts for the provision of travel services with customers. The list may be maintained in electronic form. Access to data contained in them will have Marshals, and the minister of sport and tourism. This right is particularly important for the Marshals, who are responsible for the efficient organization of return customers from tourist event, when it does not provide the insolvent tour operator or travel agent (in terms of accommodation, local transportation and transportation to the country).
According to the draft amendment to the Act, Marshals and the minister of sport and tourism will be entitled to control the travel agencies in terms of declaration and payment of contributions to the TFG and fair conduct of the list of contracts of a tourist event or tourist agency. UFG in the annual activity report will present information on the functioning and activities of the TFG. Provides for the compulsory drafting by UFG quarterly reports on the use of TFG and the transfer of its ministers: sports and tourism, and finance.
