Strengthening of the rights and guarantees for entrepreneurs, introducing mechanisms for dialogue entrepreneurs with authorities – these are some of the objectives of the new Rights of economic activity, adopted today by the government. Business Law is intended to replace the Act on Freedom of Economic Activity.
Back to “Wilczek’s Law”?The assumptions contained the constructed anew the fundamental principles of commercial law, including freedom of establishment, equality and non-discrimination. The bill will retain certain provisions of the Act on freedom of economic activity in 2004. The government also wants the return of the so-called rule known. “Wilczek Act,” or “what is not prohibited by law – is permitted”, it means that in areas not regulated by law, the entrepreneur will have freedom, if not infringe upon the rights and freedoms of others.
Legal Concerns – in favor of the companies
An important element of the new economic order is to be as gentle interpretation of the rules. Administration for not offering to remove doubts of interpretation legislation (also in case of possible multiple interpretations) will be required to arbitrate in a way that does not worsen the situation of the entrepreneur.
– The introduction of the Act guiding principles of economic law is to encourage officials to use them and thus strengthen the relationship between administration officials and persons conducting business activities in Poland – says Deputy Prime Minister and Minister of Economy Janusz Piechocinski.
Businesses are honest
The economic regulation will be introduced the principle of presumption of honesty entrepreneur. Unclear factual or evidentiary difficulties so far acted to the detriment of entrepreneurs.
The Guidelines further provide the possibility of extending the suspension of business activity up to 36 months and the introduction of the so-called. reasonable deadlines for entrepreneurs – Authorities will be required to determine the real entrepreneurs and sufficient time to perform a certain action.
