The revolution in the law of succession. From August 17 – Virtual Poland

One court, one law, one drop. From Monday August 17th revolution awaits us in the law of succession borders. In order to inherit property located outside the country you will not need to have to go to the state.

All formalities will complete a Polish court, it provided that the testator has indicated that the property should be handed over under Polish law.

If the testator does not do this, the proceedings will be conducted in the place of his permanent residence for life, even if the properties are located in several countries.

The exception are the estates of relatives from the UK, Ireland and Denmark. These countries benefited from the so-called. opt-out clause, which means that the new regulations will not be affected.

The new law also introduces a European Certificate of Succession, which was designed so that the legal position of the deceased in all countries did not raise doubts. It is to protect their rights and other parties, such as lenders.

Cross-border falls now represent over 10 percent of all cases of succession within the EU, nearly 450,000 cases a year, including assets of around 123 billion euros.
